Tricon Virtual Server Policy & Agreement

Since the Internet is a voluntary association of users willing and interested in exchanging information, we require our clients to act with respect, courtesy, and responsibility to other Internet users. This entails that our clients must follow restrictions on mass advertisements, pirating/copying of software, or any other method that denys service to other users and violates security. In additon, the CLIENT is responsible for validating the integrity of the information and data it receives or transmits over the Internet.

SERVICE AGREEMENT

Parties
This agreement is between Tricon Web Force ( PROVIDER ) and the party as specified in the application ( CLIENT ).

Start of Services
The Services will be activated the same day as receival of the contract or payment provided that the CLIENT is set to be on the Internet, if not a schedule will be provided.

Quality of Services
Although the PROVIDER will make the best efforts to provide quality and uninterrupted services this is not guaranteed. PROVIDER will not be held responsible for any damages a service interruption may cause to the Client. Further PROVIDER will not censor any content on Internet. It will be CLIENT's responsibility for the usage of his account and any consequences of this usage.

Fees and Late Payments
CLIENT agrees to pay for the services setup fee, monthly fee, and overtime fee (if any). Web hosting billing occurs in three month increments. Quarterly payments must arrive by the 1st of each new quarter in order to ensure service will continue uninterrupted. Accounts not starting at the 1st of the month will be prorated accordingly.

Payment Methods
CLIENT agrees his account to be charged as specified in the application and the bills to be sent by E-mail only. All payments will be in the form of money order or check.

Lawful use of Internet
CLIENT agrees to use Internet in accordance with the law including the ethical rules established and those to be set up in the future. This includes but is not limited to principles protecting against copyright, libel & defamation of character, and invasion of privacy.

Unlimited usage accounts
All unlimited usage accounts are subject to the following restrictions:

Only for personal use.
Any kind of reselling, sharing, service providing to other parties is strictly prohibited.
The PROVIDER reserves the right to cancel violators accounts without compensation.

Right of Refusal
PROVIDER has the right to refuse services to anyone.

Limited Liability
The liability of PROVIDER is limited to the fees collected for future services.

No Returns
PROVIDER will not return collected fees for services.

Security and Integrity of Information
There is no guarantee that the information on Internet is absolutely secured or never may be destroyed. CLIENT agrees to keep the PROVIDER harmless in case of loss of information or loss of privacy.

Price Change
PROVIDER has the right to change the price of the services to reflect a change in the cost of the service.

Agreement
This Agreement constitutes the entire understanding and contract between the parties and supersedes any and all prior oral or written representations, communications, understandings and agreements between the parties with respect to the subject matter hereof. The parties acknowledge and agree that neither of the parties is entering into this Agreement on the basis of any representations or promises not expressly contained herein.

Modification
This Agreement shall not be modified, amended, canceled or in any way altered, except by an instrument in writing and signed by both of the parties hereto.
